im sitting at school right now in the cafe and today they are handing out free dunkin doughnuts with every coffee order. they do not have dunkin's permission and the chic that baught them did not even get permission from her boss (the owner of the cafe).
im assuming that she did this just to be nice, so i feel that i shouldnt say anything to her about the legality of it.
and at the same time im wondering if im the only one that sees a problem in it because im in business law. but im just thinking how bad this one "nice" act could turn out to be!

on one hand it makes a lot of difference that it's a school cafe. on the other hand, it's never ok to do something with/for customers without clearing it with the manager.

She paid for those donuts, and as such they are free for her to do what she will with, so I don't see Dunkins' lack of consent to be a factor. She is not claiming to have made the donuts, etc.

She is boosting profits even if only a little with a promise of free doughnuts.
It's nice. but at the same time its' not like she's handing out pastries from that specific facility. So things could possibly go bad if upper people wanted them to.

1) the cafe is not owned by the school, just operating on school grounds
2) she was standing there saying "buy a coffee and get a free doughnut"
3) the cafe sells their own pastries!!!!

wait Im confused....she bought the coupons?...if so then DD was paid already for the doughnuts, so it's like getting a gift certificate (sorta)
but she should have gotton permission from her boss since she's promoting a competitor....hummm...
I'd prolly give her a heads up (sometimes your brain doesn't work...it happens to all of us) but not like in a "I'm getting you in trouble" way.

it has more to do with liability and safe food handling practices. basically the manager will be under fire if something ridiculous happened like peanut dust flew in the donuts while she was driving them there and someone had an allergy. the same guarantees don't apply for food safety when an individual is distributing it unofficially, versus people in certified facilities, but people would still place responsibility on the owner.

This is true, I think.
As long as she isn't claiming to have made the donuts, and she paid for them, it's fine. If I buy shirts in bulk, and decide I don't want to wear them, I can give them away or sell them, can't I?
But because it's a business, she shouldn't sell them; giving them away is fine. But she needs to clear it with her manager.
So, yeah. No problem, imo.
I hope I made sense in all that blabber.
